What are Family-Based Petitions?

Family-based petitions are the first official step through which a U.S. citizen or a lawful permanent resident can request that the government allow a foreign relative to obtain an immigrant visa or adjust their status to live legally in the United States.

CAN PETITION FOR:

  • Unmarried children (minor or adult)

Note: Permanent residents cannot petition for parents, siblings, or married children.

Form I-130

Petition for Alien Relative. This is the form that begins the entire process.

Formulario I-485

Adjustment of Status. Used to apply for permanent residence if the family member is already in the United States.

Form I-601A

Provisional Waiver. For family members who entered without inspection and need to leave the country.
